These Terms of Service ("Terms") are a binding agreement between you and Bindu Intelligence LLC, a Delaware limited liability company. By creating an account, clicking "I agree," or using Cosmic AI, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and Refund & Cancellation Policy, which are incorporated by reference. If you do not agree, do not use Cosmic AI.

1. Eligibility (13+; under-18 requires parental consent)

You must be at least 13 years old to use Cosmic AI. If you are under 18, you may use Cosmic AI only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. Cosmic AI is not for children under 13. See our Children's Privacy & Age Policy. By using Cosmic AI you represent that you meet these age requirements (and have parental consent if under 18) and that you are not barred from using the service under the laws of the United States or your jurisdiction (including US sanctions and export lists).

Provider-routing note:Some third-party models we route to (for example, Anthropic's Claude) require users to be 18 or older. We may restrict which models are available to users under 18 so that your use complies with each provider's terms.

2. Description of the Service

Cosmic AI is an AI aggregation platform. We route your requests to various third-party AI models and tools (including those from OpenAI, Anthropic, Google, DeepSeek, Suno, and others) and provide features such as chat, voice, image generation, file analysis, deep research, memory, and projects.

AI outputs may be inaccurate.AI can "hallucinate," produce false, biased, offensive, or out-of-date information, and is not professional advice (legal, medical, financial, or otherwise). You are responsible for evaluating and verifying outputs before relying on them. We do not guarantee any specific result, model, or availability, and models may change or be removed at any time.

3. Accounts and Security

You may sign in via Google, Apple, or X (Twitter), or use a guest session. You are responsible for activity under your account and for keeping your credentials secure. We offer two-factor authentication (2FA) and recommend enabling it. Notify us promptly at [email protected] of any unauthorized use.

4. Wallet, Credits, Subscriptions, and Payments

• Credits. Usage is billed in credits. One US dollar equals a fixed number of credits as shown at purchase. Credits have no cash value and are not redeemable for money.
• Subscription credits are included with a recurring plan and reset at the end of each billing cycle (they do not roll over) unless stated otherwise.
• Purchased (top-up) credits do not expire and remain until used.
• Billing. On the web, payments are processed by Polar as our merchant of record; Polar issues invoices and applies any sales tax or VAT. On mobile, purchases are processed by Apple or Google and are also subject to their terms. We do not store full card numbers.
• Auto-renewal. Subscriptions renew automatically until cancelled. Renewal terms, price, and how to cancel are described in the Refund & Cancellation Policy.
• Failed generations. If a model fails to respond due to a technical error on our side, the credits for that request are not charged (or are restored).
• Price changes. We may change prices or credit rates prospectively with notice; changes do not affect a billing cycle already paid.
• Taxes. Prices exclude taxes unless stated; you are responsible for applicable taxes.
• Chargebacks. Filing a fraudulent chargeback may result in suspension and collection of amounts owed.

5. Acceptable Use

Your use is governed by our Acceptable Use Policy. In summary, you may not use Cosmic AI for anything illegal or harmful, to generate Child Sexual Abuse Material (CSAM) or other illegal content, to bypass safety filters ("jailbreaking"), to infringe others' rights, to scrape or resell the service without a license, or in violation of any third-party model provider's terms. We may remove content and suspend or ban accounts that violate these Terms.

6. Your Content and AI Output

• Your input.You retain ownership of the prompts, files, and other content you submit ("Input"). You represent that you have the rights to submit it and to allow us to process it as described in the Privacy Policy.
• License to us. You grant us a worldwide, non-exclusive license to host, process, and transmit your Input to third-party providers solely to operate and improve the service (see the Privacy Policy for how we handle review and quality improvement). We do not use your content to train AI models.
• Output.Subject to these Terms and the underlying providers' terms, we assign to you whatever rights we have in the content generated for you ("Output"). Because AI may produce similar outputs for others, Output is provided without a guarantee of uniqueness, ownership, or non-infringement.
• Feedback. If you send suggestions, we may use them without obligation to you.

7. Our Intellectual Property

Cosmic AI, including the interface, the Smart Router logic, software, and branding, is owned by Bindu Intelligence LLC and protected by law. We grant you a limited, revocable, non-transferable license to use the service under these Terms. You may not copy, modify, reverse-engineer, or create derivative works of the platform except as permitted by law.

8. Third-Party Services

The service depends on third-party AI providers and payment processors. Your use may also be subject to their terms and policies. We are not responsible for third-party services, and their availability or terms may change.

9. DMCA / Copyright

We respond to valid copyright notices under the DMCA. See the DMCA / Copyright Policy for how to submit a takedown or counter-notice. Our designated agent is Copyright Agent, Bindu Intelligence LLC, reachable at [email protected].

10. Termination

You may stop using the service and delete your account at any time in Settings. We may suspend or terminate your access if you violate these Terms, create legal or security risk, or fail to pay. Upon termination, unused subscription credits are forfeited (top-up credits handling is described in the Refund & Cancellation Policy). Sections that by their nature should survive (e.g., 4, 6, 7, 11–16) survive termination.

11. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINDU INTELLIGENCE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Bindu Intelligence LLCfrom claims, damages, and expenses (including reasonable attorneys' fees) arising from your Input, your use of the service, or your violation of these Terms or the rights of others.

14. Dispute Resolution — Arbitration & Class-Action Waiver

Except for small-claims matters and requests for injunctive relief, you and Bindu Intelligence LLC agree to resolve disputes by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware. You and we waive any right to a jury trial and to participate in a class or representative action. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Subject to Section 14, disputes will be brought in the state or federal courts located in Delaware, USA.

16. Changes to These Terms

We may update these Terms. For material changes we will provide notice (e.g., email or in-app). Continued use after the effective date of an update means you accept the revised Terms.

17. General

These Terms, plus the policies incorporated by reference, are the entire agreement between you and us. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
